Buyer - Is every visitor of the e-shop who buys products and
products on the e-shop www.tutifruti.at . For the purposes of Act No. 102/2014
Coll., a consumer is a natural person who does not act within the scope of
his/her business activity, employment or profession when concluding and
performing a consumer contract. A purchaser is also a person who is a business
entity, operating on the basis of a trade licence and purchases goods for the
purpose of their resale.
Eshop - is a public computer system located on the public
Internet network that allows buyers to order goods and products.
Goods - are all products published on the website
www.tutifruti.at
Order - is created by selecting the goods, completing the
order form in full, paying by credit card, paying through the Trustpay payment
gateway. The consumer communicates with the seller via email shop@tutifruti.at
Prices - all prices for products are final. The operator of
the e-shop is not a VAT payer. The seller is obliged to pay the price indicated
on the product page at the moment of creating the order.
Order form
The buyer orders plants through the e-shop by creating an
order. He can do so as a guest , or after registration. To complete the order,
the orderer must enter name, address, email, phone number. If the customer
wishes to have a different delivery address other than the billing address,
he/she fills that in as well.
The buyer can also send the order via email
shop@tutifruti.at but must include in the email: name, address, phone number,
product name and quantity requested. Confirmation of the order will come to the
buyer via email. Confirmation of the order by the Seller creates a contract of
sale, which may be amended, cancelled or supplemented only by mutual agreement
between the Buyer and the Seller, unless otherwise provided by law or other
legal regulation. By sending the order, the buyer agrees to the price of the
ordered goods and thus the order becomes binding for the consumer. After
creating an order in the e-shop, an e-mail is automatically generated to the
buyer confirming that the order has been accepted by the e-shop. By sending the
order, the buyer is bound to pay the purchase price of the ordered goods unless
the parties agree otherwise. If the Seller is unable to fulfill the order or
part of it within the time limit for processing the order with the best efforts
due to reasons such as the goods are not produced, are not available from the
manufacturer or the external warehouse of the supplier, the manufacturer has
made such serious changes that it is not possible to fulfill the order or for
reasons of force majeure, the Seller may cancel the order, of which it will
send an e-mail to the Buyer. The Seller also has the right to cancel the order
if the Buyer has provided false or misleading information in the order that
cannot be verified, such as an incorrect e-mail or telephone contact.
Verification is deemed to be the possibility of contacting the buyer back at
the given telephone number or e-mail address. If the Buyer has paid an advance
payment, the Seller is obliged to refund it to the Buyer no later than 14 days
from the date of cancellation of the Buyer's order. If the Buyer has chosen
"Advance bank transfer"/"Payment by card" as the payment
method in the order, the Buyer is obliged to make the payment based on the data
displayed immediately after the order is created and sent. Once the payment has
been registered, the Seller is obliged to send the Buyer a tax document, in the
form of an automatic email from the system. In case the Seller does not record
the payment by the Buyer based on the method within 3 days from the creation of
the order, the Seller will send an automatic notification to the Buyer. If the
Seller does not record the Buyer's payment for his order even after sending the
automatic notification, the Seller shall be entitled to withdraw from the
Purchase Agreement and cancel the received order.
Payment terms
Payment for products in our shop can be made as follows :
Payment by bank transfer - the consumer will pay after
creating the order according to the instructions.
Payment by credit card - the consumer pays after creating
the order through the payment gateway Trust-pay
Delivery conditions
The seller carries out the delivery to the buyer through:
Gls courier company -
the buyer acknowledges that the goods we send are live plants. Plants are
shipped after receipt of the order when paying by Card / Bank Transfer - the
next day after receipt of payment. No later than 5 days . We ship plants from Monday
to Wednesday. Delivery time is usually 2-4 days of receiving the package by
courier company. We ship plants from March 1 to November 30 - depends on
weather conditions. The seller is obliged to pack the goods in such a way as to
prevent damage or deterioration of the goods during transport. The buyer is
obliged to inspect the goods, especially if there is no damage to the packaging
and the completeness of the shipment. The seller is not responsible for late
delivery of the goods.

Shipping and packing - the price for cash on delivery will
be calculated by the system according to the weight. For postage costs, please
refer to the section "Terms of delivery". We do not charge for
packing.
Prices- the prices for the goods listed on www.tutifruti.at
are valid at the time of ordering, they do not include the price for shipping.
We are not VAT payers. The invoice, which is sent to the customer both
electronically and in paper form, serves as a document. The invoice also serves
as a delivery and warranty card. The warranty period for the authenticity of
the variety is 2 years. The goods are the property of the seller until full
payment.
Cancellation of the purchase contract - the buyer has the
right to cancel the order for goods that are included in the seller's standard
offer within 24 hours of the order being placed, without cancellation fee.
Under Act No. 102/2014 Coll. on Consumer Protection in the Sale of Goods or the
Provision of Services under a Distance Contract as amended or a contract
concluded outside the Seller's Premises and on Amendments and Additions to
Certain Acts (hereinafter referred to as the "Act"), the Buyer has
the right to withdraw from the Purchase Contract within 14 calendar days from
the date of receipt of the goods, pursuant to the provisions of § 7 et seq. of
the Act. If the subject of the purchase contract is the delivery of goods, the
consumer shall also have the right to withdraw from the contract before the
delivery of the goods. The goods must be delivered to the seller at the seller's
own expense and if mechanical damage to the goods or damage caused by improper
handling or poor care occurs, the buyer must pay the full price for the goods.
The Seller is not liable for late delivery of the goods,
especially if caused unintentionally, by courier service or by force majeure.
The Seller shall not be liable for defects caused by the Buyer, namely damage
to the plants by improper care, improper handling, failure to observe
recommended cultivation rules and damage to the plant by natural disasters.

The operator of the Matej Hornák online shop handles
personal data in accordance with the rules for the processing of personal data
set out in Regulation (EU) 2016/679 of the European Parliament and of the
Council on the protection of natural persons with regard to the processing of
personal data and on the free movement of such data (GDPR). I hereby declare
and undertake that I will not disclose the personal data entrusted to me to any
third party. I give customers access to the personal data I store in the
database. At the customer's request, I will delete his/her personal data from
the database at any time in accordance with the right to be forgotten.
